Terms and Conditions
SECURING YOUR ORDER
Your order is secure and your quote accepted once you have paid the 50% deposit via bank transfer or cash. Payment details are supplied in your quotation. Unfortunately it is not currently possible to make payments by credit or debit card. A receipt for your deposit will be sent to you by email once cleared payment is received. Please note that order deposits are only refundable at my discretion. I will, as far as possible, issue a full refund up to 4 weeks before the cake is due, after this time, costs for ingredients, consumables, business lost, or time already given to your order may be deducted from payments made, up to the full value of the deposit.
Your deposit will be deducted from the total cost of the cake and an outstanding balance reminder will be sent to you approximately 14 days before delivery or collection (1 month prior for wedding cakes). Final cleared payment should be made no later than 14 days before delivery or collection (full payment is due 4 weeks prior to delivery for wedding cakes). Failure to make payment by the date it is required may result in non delivery of your cake. Only in exceptional circumstances will cash on delivery or collection be accepted as payment.
You are welcome to make final payment at any time after the initial deposit has been paid. However please be aware of the non-refundable caveat for the deposit above if costs have been incurred. Refunds may be made by bank transfer and may take up to 28 days to arrive.
CHANGING YOUR ORDER
Laura's Kitchen Cakery understands that it may be necessary to change the date, venue, size, flavour and decoration of your cake order and will make every reasonable effort to accommodate this, wherever possible. If you need to change your order in any way please speak to Laura's Kitchen Cakery as soon as possible and no later than 2 weeks before the cake is due. If you need to change the date that your cake is required or downsize your cake, please be aware that I am under no obligation to supply the ordered cake on the amended date or at the reduced size, and reserve the right to charge the original fee as agreed or treat such changes as a cancellation by you, the client.
CANCELLATION BY YOU
If you cancel your cake order please be aware that any outlay on my part in labour or materials towards fulfilling your order, or business lost, are non-returnable up to the full value of your 50% deposit. If you cancel your cake order less than fourteen days before the delivery date, Laura's Kitchen Cakery reserves the right to retain all payments made or to present an invoice for the full cost of the order.
CANCELLATION BY LAURA'S KITCHEN CAKERY
As a customer your satisfaction is of the highest priority and I will make every reasonable effort to fulfil your order to the highest possible standards. However in the unlikely event that it is cancelled due to unforeseen circumstances at any time up to and including the specified delivery date you will receive a refund of made payments up to, but no more than the quoted value of the cake or class.
Laura's Kitchen Cakery reserves the right and sole discretion to cancel any agreement or contract if new information, failure to cooperate, missed appointments, unreasonable behaviour or requests or any other factors detrimental to its business or reputation arise between the acceptance of contract and final delivery or collection. In such cases a refund will be made of the initial deposit and subsequent payments minus charges for supplied services and products.
DELIVERY AND COLLECTION
Unless otherwise stated, delivery is charged at £5 in the local Keynsham areas and £10+ within an 8 mile radius outside of Keynsham. (Delivery further afield can be negotiated and quoted for based on postcode - please make enquires). Delivery fees, times, and dates are detailed on your invoice. It is your responsibility to ensure these are correct, that I have the correct delivery address, and that someone is home to receive the cake delivery. Failure to do so may result in your needing to collect the cake from me at a later time.
Collection is free. Failure to arrive to collect your cake at the agreed time may result in your having to return to collect it later. I bear no liability if delivery or collection failure on the part of the customer results in the cake missing its intended event.
UNFORESEEN CIRCUMSTANCES
Laura's Kitchen Cakery understands just how important your order is and will make every reasonable effort to deliver your cake on the date and at the time that it is required. However in exceptional circumstances including, but not limited to, sudden illness, accident, adverse weather conditions, traffic delay and diversion, mechanical failure or other factors beyond the control of Laura's Kitchen Cakery or commonly associated with Force Majeure, delivery may be delayed or prevented. Where delivery is prevented Laura's Kitchen Cakery will only be liable up to the quoted value of the cake. Where delivery has been delayed Laura's Kitchen Cakery will only be liable up to the value of the quoted delivery price. Laura's Kitchen Cakery accepts no liability for any emotional, physical or financial distress or loss resulting from prevented or delayed delivery.
TENURE AND SERVICE
Once your cake has been delivered or collected, ownership of the cake will transfer to the customer.
After this point Laura's Kitchen Cakery will not be liable for any damage or adverse change to the condition of the cake arising from environmental conditions within a permanent or temporary venue building or its curtilage, including but not limited to sunlight, extremes of temperature or humidity, the actions of wild or domestic animals or the failure of fixtures, fittings and furniture.
In addition Laura's Kitchen Cakery will not be liable for any damage or adverse change to the condition of the cake arising from the actions of venue staff, suppliers, guests or any third party.
Upon delivery of your cake, the customer will be supplied with a set of cake instructions concerning the nature of any non edible decorative or structural items used in the cake. Laura's Kitchen Cakery will accept no liability for any damage, injury or loss resulting from the failure of a venue or customer to remove the stated non edible decorative and/or structural items upon service.
CAKE DECORATING CLASSES
Laura's Kitchen Cakery holds no liability whatsoever for any harm to persons or damage to belongings while attending classes at her place of residence or any other venue.
The full class price is payable upfront to secure your date and booking. 50% of this booking is refundable. The remaining 50% will be refunded if cancellation is made with 3 weeks' notice. After this time, the full amount (up to 50%) may be retained at the discretion of Laura's Kitchen Cakery, to cover lost sales and ingredients.
If the class needs to be postponed due to illness, we can usually rearrange for another date without incurring any fee (this is subject to circumstances - eg I may need to charge a fee for the lost cost of ingredients and time that will have already gone into preparing for the class if cancellation is last-minute). Where a new date cannot be found, the above policy applies.
GIFT VOUCHERS
Voucher Duration: Vouchers are valid for a period of 12 months from the date of purchase, unless otherwise stated. Cannot be redeemed after expiry date.
Postal Vouchers: There are additional costs associated with provision of a postal voucher. Such costs are added to the voucher cost and shall be paid at the point of purchase - please allow up to 7 days for the delivery of a postal gift voucher.
Voucher redemption: Services must be pre-booked. Laura’s Kitchen Cakery retains the right to refuse service on dates that are not freely available. In this event, other dates will be offered. Redemption contact details are provided on the voucher.
Refunds: Vouchers are non-refundable, other than within the 14-day cancellation period as per the Consumer Contracts Regulations 2013. No change or credit given in the event that the voucher value exceeds the total cost of the services provided - eg where a £50 voucher is used to purchase a £49.50 course.
Monetary Vouchers: Monetary vouchers can be used for part or full payment of a cake decorating class or cake order only. If the service desired exceeds the amount of the gift voucher, the balance must be paid in full at the point of booking.
Availability: Laura’s Kitchen Cakery does not guarantee that spaces will be available on classes or in the baking diary (for an order). Spaces are only secured once a place/order has been booked, so it is recommended you book as early as possible to avoid disappointment.
Transfer: Vouchers are non-transferable and cannot be exchanged for cash.
Lost or Stolen Vouchers: Lost, stolen or destroyed gift vouchers will not be exchanged or refunded.
Cancellation: In the unlikely event that a class or booking needs to be cancelled by Laura’s Kitchen Cakery, a new gift voucher shall be issued and shall be valid for a further 12 months. In the event that a cancellation is made by a voucher holder no refund shall be given.
COMPLAINTS
In the unlikely event that you should wish to complain about any aspect of the service provided by Laura's Kitchen Cakery, please describe the full nature of your complaint by email as soon as possible. In cases where investigation and examination of cakes or parts of cakes is required, at least 75 per cent of the uneaten cake must be returned no later than 24 hours after delivery. In such cases all cakes must be stored and transported correctly and appropriately prior to their return. Laura's Kitchen Cakery will not accept any liability for any reduction in quality or adverse changes arising from the environmental conditions within a venue, the actions of venue staff, suppliers, guests or any third party or the actions of wild or domestic animals or the failure of fixtures, fittings and furniture. Full or partial refunds will only be made in exceptional circumstances and will be at the sole discretion of Laura's Kitchen Cakery
MARKETING
Laura's Kitchen Cakery reserves the right to take photographs of any supplied cake for marketing purposes or publication.
ALLERGY ADVICE
My cakes are prepared in a kitchen where celery, gluten, lupin, milk, mustard, nuts, peanuts, sesame, soya, sulphur dioxide, crustaceans, fish, molluscs are used, have been used or where traces may be present. Whilst every reasonable effort is made to reduce the risks of cross contamination Laura's Kitchen Cakery cannot guarantee that traces of any of the items on the above list will not be present. It is the customer’s responsibility to notify Laura’s Kitchen Cakery of any allergies, at least 2 weeks before the cake is due.
